Terms of Service

PLEASE READ CAREFULLY. By accessing any Militia Gaming League (“MGL,” “we,” “our,” or “us”) website, sub‑domain, Discord server, or participating in any MGL event, you (“you,” “your,” “player,” or “team”) agree to the terms below, our Privacy Policy, all posted rule sets, and any guidelines specific to individual competitions (collectively, the “Terms”). If you do not agree, do not use our Services.

1. Glossary & Parties

  • Site(s) – militiagamingleague.com, its sub‑domains, and partner sites operated by MGL.
  • Services – All websites, Discord servers, matchmaking tools, tournaments, leagues, and premium membership features provided by MGL.
  • Skill Competition(s) – Any MGL‑sanctioned season, tournament, promotion, or event, including free or paid entries.
  • Captain – The registered representative for a team; MGL communicates prize distribution and official notices only with the Captain.

2. Acceptance of Terms

By using the Services or entering a Skill Competition you confirm that:
1. You have read, understood, and accept these Terms in full.
2. You will comply with every applicable rule, policy, and code of conduct we publish—whether on the Site, Discord, or official social channels tagged #MGLRules.
3. You assume sole responsibility for obeying all laws that apply to you, including age, tax, and gaming regulations in your jurisdiction.

3. Payments & Refunds

  • Non‑Refundable Fees. All payments—including team registrations, roster changes, rebranding fees, ownership transfers, donations, and subscription fees—are final and non‑refundable.
  • Membership Billing. Subscriptions renew monthly on the calendar day of original purchase (or last day of shorter months). Promotional discounts apply only to the first term.
  • Failed Payments. If a renewal fails due to outdated payment details, MGL may suspend membership benefits until payment is resolved.

4. Legal Compliance & Eligibility

1. You must be a natural person at least 18 years old (or older if required by local law). Players under 18 need written parental consent.
2. Participation in fee‑based tournaments for prizes is void where prohibited. Residents of Alaska, Arizona, Delaware, Iowa, Maryland, Tennessee, Vermont—and any other restricted region—may not enter paid events.
3. You are solely responsible for confirming that joining a Skill Competition is legal where you live. MGL disclaims any duty to provide legal advice.

5. Site Services

MGL provides a platform to arrange and track games of skill (never gambling or chance). Users set match details, fees, and prizes; MGL records results, settles disputes, and distributes winnings.

6. Competition Rules & Enforcement

  • Every event is governed by the MGL Rulebook posted at nba2k.militiagamingleague.com/rules. Captains must review updates regularly.
  • Failure to follow current rules results in immediate forfeiture; repeated or egregious breaches may trigger suspensions or lifetime bans.
  • The Gameplay Committee (community volunteers) may recommend mid‑season bans on newly discovered glitches or exploits. Announcements appear in Discord and on Twitter.
  • Disputes & Unplayed Games. If teams cannot complete a series within the sanctioned window, MGL will advance a winner at its sole discretion based on documented scheduling efforts.
  • Admin Authority. MGL decisions are final. Your only remedy for disagreement is to stop using the Services.

7. Account Integrity

  • All gamertags/PSNs on a roster must be legitimately owned by their players. Sharing, buying, or renting accounts is prohibited.
  • Opponents may request mic checks before tip‑off. Provide clear, unedited video proof for any eligibility claim.

8. Prizes & Tax Reporting

  • Prizes are credited to the Captain’s MGL Wallet (or directly to teammates if the Captain specifies).
  • U.S. players earning $600 USD or more in a calendar year must submit a valid Social Security Number for IRS Form 1099 reporting. Failure to comply forfeits unpaid winnings.

9. Prohibited Conduct

9.1 Illegal Funds & Money Laundering

You may not use the Site to transfer illicit funds. Suspected fraud leads to immediate account suspension and notification of authorities.

9.2 Collusion & Cheating

Sharing inside information, win‑trading, or any scheme that undermines fair play will result in permanent bans.

9.3 Abuse & Exploits

Creating multiple accounts, using scripts or modified hardware, impersonation, or intentionally throwing games for advantage is strictly forbidden.

10. Disclaimers & Liability

  • No Warranty. Services are provided “AS IS” and “AS AVAILABLE.” We disclaim all implied warranties.
  • Limited Liability. Our maximum liability to you is the most recent Service fee you paid. We are not liable for indirect, incidental, or consequential damages.
  • Some jurisdictions restrict liability limitations; in such cases our liability is limited to the fullest extent allowed by law.

11. Intellectual Property & User Content

  • You grant MGL a perpetual, worldwide, royalty‑free license to use any content, submissions, streams, team logos, or social posts related to MGL events for marketing and promotional purposes.
  • You may not copy, reverse‑engineer, or redistribute Site content without express permission.

12. Cookies & Data

We use cookies to enhance functionality. Your continued use of the Site constitutes consent. See our [Privacy Policy] for full details.

13. Community Content & Comments

Users may post comments on certain Site pages. MGL does not pre‑screen posts but reserves the right to remove content it deems inappropriate. By posting you warrant you own or control the rights to your content and grant MGL a license to use it.

14. Linking & Hyperlinks

Government agencies, search engines, and accredited businesses may link to our Site without prior approval so long as the link is not misleading or defamatory. MGL may request removal of any link at any time.

15. Modification & Termination

  • Terms Updates. We may change these Terms at any time. Continued use of the Services after changes means you accept the new Terms.
  • Service Changes. Events, prize pools, or platform features may be modified or discontinued without notice.

16. Governing Law & Venue

These Terms are governed by the laws of the State of New York, USA. You consent to exclusive jurisdiction in the state and federal courts located in Kings County, New York.

17. Indemnity

You agree to indemnify and hold MGL, its officers, employees, and affiliates harmless against all claims arising from your breach of these Terms or misuse of the Services. MGL is entitled to recover reasonable legal fees in any dispute.

18. Miscellaneous

  • No Agency. Nothing in these Terms creates any partnership or employment relationship between you and MGL.
  • Severability. If any provision is found unenforceable, the remainder remains in effect.
  • Waiver. Failure to enforce any right does not waive that right.
  • Assignment. MGL may assign these Terms; you may not.

By continuing to use the Services you acknowledge that you have read, understood, and agree to abide by all provisions above.
